Christian Brueckner’s lawyer claims he found evidence that his client did not kidnap Madeleine McCann.

Friedrich Fuelscher was investigating the areas around the apartment in Praia da Luz, Portugal, where the McCanns were staying when three-year-old Madeleine disappeared on May 3, 2007 between 9:10 p.m. and 10:00 p.m.

Mr Fuelscher said, “If the testimony is correct, there was a one-minute and 30-second window in which the child could have been abducted.”

Cell phone recordings brought Brueckner, 43, to Praia da Luz when Madeleine was missing.

After moving from different locations in the resort to the apartment, Mr. Fuelscher stated: “My client did not commit this crime.”

German Attorney General Hans Christian Wolters said there was “material evidence” that Madeleine was dead.

Brueckner had previously been convicted on a number of charges, including possession of sex pictures of children and rape of a pensioner

He is currently serving a 21-month prison sentence in Kiel, northern Germany, for drug trafficking.

But he claims it has nothing to do with Madeleine’s disappearance.

The convicted pedophile is in a prison in Kiel, Northern Germany, for drug trafficking and rape of a 72-year-old American woman in the Algarve.

The rape occurred about 18 months before three-year-old Madeleine, from Rothley, Leicestershire, disappeared.

Brueckner was sentenced to seven years for the attack on the American and 21 months for drug trafficking.
