Former Collingwood star Héritier Lumumba is suing the club and the AFL for racial abuse he was exposed to while in the league.

In documents filed with the Supreme Court this week, Lumumba claims the Pies failed to do their “due diligence” to create a safe work environment.

The documents also allege that the AFL “owed the plaintiff (Lumumba) a duty to take reasonable steps to prevent players from subjecting other players to racist abuse and racially offensive behavior, and to players who violate these rules, To impose sanctions ”.

“During his employment, the plaintiff was repeatedly exposed to racist abuse or racially offensive behavior,” the court documents read.

“(Collingwood) has taken no or insufficient steps to create and maintain a safe work environment, including by protecting the plaintiff from racial abuse or racially offensive behavior.”

Lumumba played 199 games for Collingwood, including both a Premier League and an All-Australian selection in 2010.

He was taken to Melbourne in late 2014, where he says the racial abuse has stopped.

The allegation also alleges that “Plaintiff has suffered loss, damage and injury, including trauma, humiliation, hardship and loss of enjoyment, as a result of the matters set forth above.”

Earlier this year, Collingwood announced that an independent review of the club’s culture would be conducted during Lumumba’s time.

In June, he wrote an open letter to the club that was shared with Foxfooty.com.au.
