Mariana Ferrer is one of the most talked about names of recent days on social media, after several images of the young woman’s trial against André de Camargo Aranha, who the influencer accused of raping her when she was 21, during a party in Florianópolis, in the year of 2018, have been shared by The Insider Brasil. The influencer lost the case against the gambling entrepreneur André de Camargo Aranha, considered a very influential man in Brazil, in September of this year, when he was found innocent by the Santa Catarina Court, despite there being numerous evidence in favor of the influencer. Now, the images of the trial show the prosecuting attorney humiliating the young woman and showing her sensual photos to reinforce that what had happened that night between Mariana Ferrer and her client had been consensual.

The images show lawyer Cláudio Gastão da Rosa Filho during the online trial displaying photos of the young woman as a professional model, taken before the crime occurred. In showing Ferrer’s photographs, the lawyer dubbed them “gynecological” and even went so far as to say that “he would never have a daughter of the same level” as the 23-year-old. Even when Ferrer starts to cry, Gastão asks him to stop “the concealed, fake crying” and still with his “crocodile lip”.

Ferrer cried several times during the trial and it was rare for the judge in the case, Rudson Marcos, to intrude. “Your Honor, I’m begging you for respect, not even the accused are treated the way I’m being treated, for God’s sake, people. What is it?”. In the video shared by Intercept, the only time Marcos goes to Mariana is to warn her that he is going to stop recording so she can compose herself and drink water and asks the lawyer to maintain a “good level”.

During the trial, the prosecuting attorney questions Mariana about the publications on social media where she claims to have been drugged on the night of the alleged violation, since she does not remember many moments of the party, and where she stresses that she was a virgin until the date of the crime , something that was proved by the expert examination. “Do you live on that? This is your breeding ground, right, Mariana, this is the truth, right? Is it your bread, the misfortune of others? To manipulate this virgin story?” Asked Cláudio Gastão.

Netizens have shared the video on their social networks, where they defend Ferrer and call Gastão’s stance “unthinkable” and “unacceptable”. Another situation that shocked the online community was that the court decided that the businessman had no way of knowing, during the sexual act, that the young woman was not in a position to consent to the relationship, so the violation occurred “without intention” – a situation that the newspaper The Intercept Brasil dubbed ‘culpable rape’, an expression that is now being used a lot on social networks – and netizens revolted with the situation and showed themselves on the side of the influencer.

Ferrer alleges that there is several evidence in his favor, such as the audios that she sent to three friends on the night of the party, where she is frightened by the presence of Aranha after having descended the stairs of the dressing room where the crime occurred, in addition to the statements of her mother and the Uber driver who took her home. According to the mother, Mariana was not used to drinking and had never arrived home so upset as that night. The driver also said that the young woman spent the trip, from the party to the house, crying and talking to her mother on her cell phone and it seemed to her that she was on drug effects.

During the process several situations have already occurred that revolted the international council, such as the disappearance of incriminating photographs, the change of the accused version and changes in the panel of judges. The prosecutor defends his decision and says that the toxicological tests did not recognize either alcohol or drugs in Mariana’s blood that night and in the existence of images of Mariana captured by the street cameras, where she seems to be sober. Judge Rudson Marcos agreed with the prosecutor’s thesis and stated that “it is better to acquit 100 guilty parties than to convict an innocent person”. Mariana’s defense appealed the decision.
