Dr. Shawki Allam, Grand Mufti of the Republic, Head of the General Secretariat for Fatwa Authorities and Roles in the world, said: The issue of divorce is one of the issues that trouble society the most, because of its dire and devastating effects on the Egyptian family and on society as a whole. This requires all of us to take a serious stand to raise awareness among citizens of the dangers of doing so divorce At the impossibility of ten, and the serious social consequences that are not hidden from anyone, it is an issue of awareness in the first place.
This came during his weekly meeting on the Nazra program with the journalist Hamdi Rizk on Sada Al-Balad TV, adding that the honorable Sharia instructed the spouses not to rush to sever the marital bond when there is any problem or face obstacles, but they should adhere to it; This is done through early preventive measures, which are the necessity of treating with kindness and compassion, good faith, sharing in bearing the burdens of life, and taking into account the circumstances of each other.
Dr. Shawky Allam drew attention to the fact that Dar Al-Iftaa is taking several preventive measures in order to fortify the building of the family. In recent years, it has launched several specialized programs in this regard, such as the “Qualifying those who are about to get married”, which aims to educate those who are about to get married, as well as the establishment of a specialized unit for family counseling, where problems are referred to it from the various Fatwa departments, as well as the Department of Family Dispute Resolution. In family counseling sessions, issues of divorce are discussed, in the presence of a legal representative from Dar Al Iftaa, along with specialists in psychology and sociology. for many divorce cases; Taking into account the conditions of people, and in the interest of maintaining the marital relationship.
Concerning the oath of divorce, the Mufti indicated that approximately 4000-5000 fatwas of divorce come to the Iftaa House every month, most of which are oaths and oaths of divorce, one of which falls in a thousand, and perhaps none of it occurs; This is because the scholars of Dar Al-Iftaa have experience with which they can know whether this was a valid divorce or an oath of divorce? And that is through their accumulated experience that they received from their sheikhs and is not found in books.
The Mufti of the Republic explained that dealing with divorce cases is carried out according to an organized and disciplined method that goes through three stages. It begins with the Fatwa Trustee’s dealings with it. If a solution is not possible for the trustees of the Fatwa to suspect that it has occurred, it is referred to a specialized committee consisting of three scholars. If there is a suspicion that the divorce took place, it is referred to him personally, and he may host the parties to the divorce incident in his office to ensure that the divorce took place or to find a solution, and this is in order to preserve the family, which is the nucleus of society.
Among the provisions of divorce, as mentioned by the eminent Mufti, is that the woman remains in her home during the waiting period with her husband; Because the marriage relationship still exists, the Almighty said: (And their husbands are more deserving of their return in that if they want reform), as if the Holy Qur’an sets the stage for the waiting period, perhaps God will then bring about another matter that will help bring them together again. Therefore, the jurists advised the woman and the man to review their position during the waiting period.
The Mufti added that the waiting period of a divorced woman is three months for an elderly woman who has given up menstruation, or three menstrual periods for a young woman, and if she is pregnant, her waiting period expires when she gives birth.
The Mufti of the Republic demanded that the husbands, if they decide to divorce, be satisfied with one shot, so that they have the opportunity to review their wives if the matter is settled between them. The Egyptian law counts divorce as one shot if the husband pronounces it three times; In order to preserve the family, he pointed out that if the authorized person doubts a divorce case, the questioner must be referred to the Dar al-Iftaa to solve the problem. On our part, if the divorce takes place, we say to the husband: It is necessary to go to the authorized person and document the divorce.
The Mufti of the Republic commended the response of Counselor Omar Marwan – Minister of Justice – to the initiative launched by his eminence to rehabilitate those authorized to investigate divorce before it is proven in the official document to confront the phenomenon of high rates of documented divorce, and to follow the legal methods that guarantee the documentation of divorce, which included training more than 900 authorized In the office of the Ministry of Justice over a period of five days.
The Grand Mufti concluded his dialogue by advising the spouses to ensure the continuation and care of the marital relationship and to solve the problems they face with wisdom, and that the husband does not use the word divorce except to treat a marital problem that makes it impossible for the continuation of married life, and that the husband does not make the word divorce in transient and inappropriate situations.
